Terms and Conditions of Sale.
1 - Premise:
All commercial relationships between Saporilandia by Luca Lovino (sole proprietorship, later known as Saporilandia only) and Customers are regulated exclusively by the following general conditions of sale.
Excluding any other agreement, if not agreed in writing, the inclusion of an online order also implies full acceptance of the following conditions.
Any person acting on behalf of the Customer will represent and commit to Saporilandia since the customer is directly responsible for the confidential storage and use of his personal password.
2 - Responsibility:
Saporilandia declines any responsibility for damages or losses, direct or indirect, deriving from the goods - of which it is a mere distributor - or from their use and from the provision of services - of which it is a mere intermediary - specified and published on our website. It also declines responsibility for delayed or non-delivery of the product where there is a correct documentation that proves the unsuccessful withdrawal or the correspondence of specifications published on the website.
3 - Technical Information:
The technical information entered on the Internet site, are derived from the information published by the manufacturers of the goods included in our catalog. Saporilandia reserves the right to modify / adapt the technical and dimensional information of the products in the catalog, based on what will be communicated by the producers, even without any prior notice; save orders already forwarded and accepted.
4 - Orders:
E-commerce orders can be forwarded exclusively via the Internet (online).
The customer who sends the order via the Internet will receive, at the end of the procedure, a communication confirming that the order proposal has been included in our information system. The confirmation of the acceptance of the order or the refusal of the same (for accounting, administrative or for lack of product) comes at a later time by e-mail (E-mail).
At the conclusion of the contract the order will be filed on our server.
At the time of compilation of the First Order there are mandatory fields to be filled out; upon returning to our Site (as a User-Registered User) it will be sufficient to insert UserID and Password to view their data and modify them if necessary. The responsibility for the management of UserID and Password is exclusively and strictly for the Customer who undertakes to immediately notify our Company of any unauthorized use as well as any other breach of the security rules he becomes aware of. In default the responsibility is always and only of the Customer. In addition, the user agrees at the end of each session to exit from their account with the appropriate command placed on our site. Our site is subject to detailed access control and through the log of the same we will be able to demonstrate any behavioral discrepancies of the customer and contest them.
5 - Prices:
All prices entered on the site are intended to be suggested list prices for the end user - including VAT (B2C). Prices and list discounts can be changed at any time, without any prior notice, except for orders already accepted.
6 - Products Availability:
Saporilandia does not guarantee the certainty of assignment of the ordered goods, as long as the order itself is not accepted and the acceptance communicated to the customer.
Terms and Conditions - Shipping and Delivery:
Shipments, unless otherwise agreed, will be carried out by carriers defined by Saporilandia.
In this case, and only when the shipping cost is charged, the goods travel at risk of Saporilandia. In case of theft / loss confirmed by the carrier, Saporilandia undertakes to send a new product and, if it is unavailable and / or out of stock, will propose a different product, but with equivalent characteristics, with the option for the customer to do not accept this new product and request the issuing of a credit note related to the product itself.
List prices do not include transport, handling or installation costs.
In the hypothesis that the carrier is in charge, in any way by the customer, Saporilandia will not be responsible for the loss and / or damage of the product from the moment of delivery of the goods to the carrier at its warehouses.
The delivery to the Customer, unless otherwise agreed in writing between the parties, will take place on the street level and during office hours: from 8.30 to 13.00; from 2.00 pm to 7.00 pm, every day except holidays, from Monday to Friday. Transport costs will be calculated when completing the order.
The deliveries that make essential and accessory services indispensable (eg deliveries to the floors, both upper and lower, hydraulic tailgate for the grounding of bulky items, etc.) must be strictly agreed upon ordering. Therefore no dispute about this will be accepted later.
Risk and Property:
The goods are shipped free port, insured with charge on the invoice.
In the event that the goods were shipped to the assigned port, upon indication of the customer, the risk is to be considered to be borne by the customer from the delivery of the goods to the carrier at our warehouses.
Upon receipt of the goods, even in the presence of packaging intact, the customer is required to immediately ascertain the conformity of the goods with respect to the purchase order made. In particular, it must verify the integrity of the goods and the quantitative and qualitative correspondence with what is indicated in the order and in the accompanying document (DDT).
In case of discrepancy or apparent defects, these must be reported under penalty of forfeiture, on the same accompanying document and confirmed, within seven days of delivery of the goods, via email to email@example.com so that you can find, where possible, a solution.
Any report made after this deadline will not be taken into consideration.
The customer will answer for any damage resulting from false reports and statements.
Terms and conditions - Payments:
Terms of payment:
Pay Pal, Credit Card (by PayPal Service), Advance Bank Transfer.
The products ordered by the Customer will be kept busy until receipt of proof of bank transfer, to be sent to Saporilandia (via e-mail) no later than 3 working days from the date of acceptance of the order. The sending of the order will take place only at the time of actual crediting of the amount due on the c / c of Saporilandia that must be within 7 working days from the date of acceptance of the order. If you exceed these deadlines, the order will be automatically canceled.
The purpose of the bank transfer must include:
- the order reference number.
- name and surname of the holder of the order.
For every order made Saporilandia will issue an invoice of the material sent, sending it via e-mail to the order or allowing the download within the site, pursuant to Article 14 D.P.R. 445/2000 and DL 52/2004. For the issuance of the invoice, the information provided by the Customer at the time of the order shall prevail. No change in the invoice will be possible after the issuance of the same.
Payments can be made in the forms provided for by the program. If you make payments by credit card the transaction will be automatically moved, for security reasons, on the site of the bank.
The bank details for the wire transfers will be communicated by e-mail and the shipment of the goods will be carried out only when we are in possession of the payment.
Terms and Conditions - Right of Withdrawal:
The right of withdrawal is regulated according to the law if the customer-consumer (ie a physical person who buys the goods for purposes not related to their professional activity, or does not make the purchase by indicating in the order form a reference VAT number ) has the right to withdraw from the purchase contract for any reason. To exercise this right, the customer must send to Our Company a notice within 5 days from the date of delivery of the goods. This communication must be sent by registered letter with return receipt or by e-mail.
The right of withdrawal is however subject to the following conditions:
- The purchased good must be intact and returned in original packaging, complete in all its parts (including packaging and any documentation and accessory equipment); to limit
damage to the original packaging, we recommend, when possible, to put it in a second box.
- The shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the customer.
- Our company is not responsible in any way for damage or theft / loss of goods returned by uninsured shipments.
When the right of withdrawal expires:
The right of withdrawal is totally lost, due to the lack of the essential condition of integrity of the goods (packaging and / or its content), in cases in which Saporilandia ascertains:
- Partial use of the goods and any consumables.
- The lack of external packaging and / or original internal packaging.
- Damage to the product for reasons other than transport.
- In the cases indicated above, our Company will return the purchased good to the sender, charging the shipping costs to the same.
The return of goods to Saporilandia, in the cases provided for by art. 9 and 12, must be accompanied by the completion by the CUSTOMER of a special request to Saporilandia that will inform the customer on how to return.
Return requests must be received in writing or electronically within 5 days of receipt of goods.
For unavoidable timeliness needs related to relationships with manufacturers and insurance companies, claims of hidden defects must be received, and not only sent, to Saporilandia headquarters, either in writing or electronically, INDIFFERBLE within 10 days of discovery.
- The goods must be returned to Saporilandia, as indicated by us within 10 (ten) days at the address of our office.
- The material that will arrive at other sites will be rejected to the sender.
- Products must arrive in the original packaging. If this is not the case, we reserve the right to return the material to the customer with a charge for reimbursement expenses, suspending the replacement or partial accreditation and, in any case, we will charge the costs incurred by us.
- The cost of transport will be ns. load with ns. courier in case the error is attributable to Saporilandia, in all other cases it will be charged to the customer.
- In the event of a change in the price list, the amount credited will be the improvement amount for Saporilandia.
- The material assigned carriage will be rejected.
Any errors in shipping or lack of material must be reported, in written or electronic form, according to the procedures and terms indicated in point 11.
Terms and conditions - Guarantees:
The purchase of material at Saporilandia involves the full acceptance of the warranty conditions provided by the manufacturer, which may be independent of the will of Saporilandia.
The customer, therefore, is aware that the goods purchased will be guaranteed by the manufacturer and under the conditions provided. Then accept, removed each reservation, all the mode of performance of the manufacturer's warranty.
Pursuant to Law no. 196/03, the customer acknowledges that the "personal data" communicated and / or exchanged, even during the pre-contractual information phase, will be processed according to the effects and with the purposes set out in art. 12, paragraph 1, letters b), c), d) and f) of Law n. 196/03 and subsequent amendments and additions.
It is also understood that the customer expressly consents to the transfer of "personal data" pursuant to and by effect of art. 28 paragraph 4 letter a) of Law no. 196/03 and, in any case, to their communication and dissemination pursuant to and for the purposes of art. 20 paragraph 1 letter a) of the aforementioned law.
For any controversy that should arise will be competent in the first instance Saporilandia and in case of necessity the law firm that supports Saporilandia itself.
The conditions contained in this document may be changed without prior notice and will be valid from the date of publication on our website, subject to the orders already accepted.
Terms and conditions - Consent to continue
By signing for approval the onerous clauses mentioned above on the occasion of the first order following the publication on the Internet of the above general sales conditions, I intend to give approval - if they remain unchanged - also for subsequent orders, save my different and specific communication to Saporilandia.
